CONTEST RULES AND REGULATIONS (“Contest Rules”)
1. THE CONTEST AND THE CONTEST PERIOD
Turtle Jack’s Muskoka Grill’s Burger Campaign Gift Card Giveaway (the “Contest”) commences at 11:00 a.m. EST on May 9, 2023 and concludes at 11:59 p.m. EST on June 16, 2023 (the “Contest Period”).
2. ELIGIBITY
The Contest is open to residents of Ontario who have attained the age of majority, but excludes employees of MTY Food Group Inc. (“MTY”), any affiliates and/or related companies, subsidiaries, divisions (the “Affiliates”), sponsors, prize sponsors, promotional and advertising agencies as well as the parents siblings and children of any such employees and any person domiciled with such employees.
3. HOW TO ENTER
No purchase is necessary to enter or win. To enter the Contest (“Contest Entry”) complete the following methods below during the contest period (May 9, 2023 to June 16, 2023).
Entry Method:
Like the Contest Social Media post on Instagram and tag a friend in the comments of the Contest post, participant must Follow the Turtle Jack’s Muskoka Grill Instagram page @turtlejacksgrill. Each comment with a tagged friend will count as one (1) entry. Multiple entries may be earned.
4. THE PRIZE WINNERS SELECTION
The Prize winner selection will be held on June 23, 2023 at approximately 11:00 a.m. EST
A random selection for the five (5) Prize will take place at 197 King William Street, Hamilton Ontario, L8R 1A7 from among the eligible entries. The first five (5) entries selected will be eligible to win one of the five (5) Prizes. The odds of winning depend on the number of eligible entries. All entries that are incomplete or submitted through illicit means, specifically but not limited to, using any robotic or automated program to increase the odds of winning, or do not conform to the Contest Rules, may be disqualified. 5. THE PRIZES
The five (5) participants whose names are randomly drawn on the respective date will each be awarded a $200 Turtle Jack’s Gift Card. One (1) Prize per winner.
6. THE PRIZE VALUE
The approximate retail value of each Prize before taxes is $200.00
8. NOTIFICATION AND QUALIFICATION OF SELECTED WINNER
Following the draw, MTY, acting reasonably, will attempt to contact the Prize winners (“Selected Winners”) within twenty-four (24) hours after the Prize draw by direct message sent to the Selected Winners’ Instagram account. The Selected Winners must respond to the direct message within twenty-four (24) hours of being contacted.
To be declared the winner, the Selected Winner must be in compliance with these Contest Rules and must correctly answer, unaided, a time-limited, mathematical skill-testing question.
If a Selected Winner does not respond the direct message within the prescribed delay and/or fails to correctly answer the skill-testing question, he/she will forfeit their prize and an alternate winner will be randomly selected. MTY shall be fully and completely released and discharged from any liability or responsibility in this regard.
MTY cannot be held liable for any changes made by a Selected Winner to their contact information or Instagram account information and/or settings.
9. INSTAGRAM
This Contest is in no way sponsored, endorsed, administered by or associated with Instagram. By participating in the Contest, all participants release Instagram from and against any claim, loss, damage, or cause of action arising out of (or related to) their participation in the Contest.
10. RELEASE
The participants recognize and agree that neither MTY nor any of the Affiliates are making any representation or warranty of whatsoever nature and kind regarding the Prize.
Each participant releases and holds harmless MTY and the Affiliates from any loss, harm, damage, cost, fee or expense arising directly or indirectly, in whole or in part, as a result of:
a) their participation in the Contest;
b) their acceptance, non-acceptance, possession, use, non-use or misuse of the Prize;
c) the collection, use and disclosure of personal information;
d) late, lost or undeliverable e-mail;
e) injury or damage to persons or property; and
f) late, lost, misdirected, unreadable or incomplete e-mail entries.
11. GENERAL
The Contest is governed by the laws of the province of Ontario and the federal laws of Canada. To the extent permitted by law, each participant agrees that any judicial proceeding arising out of or related to the Contest shall take place in a provincial court located in Ontario. Contest void where prohibited by law. By entering the Contest, participants agree to be bound by these Contest Rules. All decisions of MTY with respect to any aspect of this Contest, including without limitation, the eligibility of the entries, are final and binding on all participants in all matters as they relate to this Contest.
MTY, without limitation, will not be liable for any failure of its email host address during the Contest, for technical malfunctions or any other problems that may occur during the Contest Period as it relates to online entries. MTY reserves the right to amend or terminate the Contest at any time without liability. 12. PRIVACY
By participating in the Contest, each participant:
a) grants MTY the right to use their personal information for the purpose of administering the Contest, including, without limitation, for the purpose of contacting and announcing the Selected Winner and coordinating remittance of the Prize; and
b) acknowledges that MTY may disclose their personal information to MTY’s agents, service providers and prize sponsors in connection with the activities specified in paragraph a) above.
